§3. Rules of using the store
To conclude a contract, the Customer must provide the data necessary to perform it. Refusing to provide this data makes concluding the contract impossible.
Product availability is shown for each product once its options are selected.
Prices shown in the store are gross prices (including taxes). They do not include delivery costs unless the product description says otherwise.
Delivery costs are shown to the Customer at checkout, before the order is finally confirmed. Delivery within Poland is free of charge (0 PLN).
Orders are shipped using trusted carriers, including InPost and UPS.
The Seller may refuse to fulfil an order if the Customer:
a. provided false data, or data that makes fulfilling the order impossible;
b. owes the Seller an overdue, unpaid amount;
c. infringes the rights of the Seller or third parties;
d. uses the store to commit an offence, or their conduct is contrary to good practice or constitutes an abuse of rights;
e. interferes with the operation of the store without the Seller's prior written consent;
f. shares access to their Customer Account with third parties;
g. breaches these Terms;
h. has twice failed to collect previously ordered goods.
Proof of the contract, provided by the Seller on a durable medium, is an invoice.
The Customer may create a Customer Account, which allows repeat purchases without re-entering their details. The Customer signs in to the Customer Account with a one-time code sent to the email address they provided; no password is used. The Customer must protect access to their email inbox. The store is not liable for use of the Customer Account resulting from the Customer failing to protect access to their email inbox.
The Customer Account is free of charge and is provided for an indefinite period. The Customer may delete it at any time.
The Seller may block a Customer Account in the situations listed above. Any unfulfilled orders are then cancelled and any payments made for them are refunded.
Purchases can also be made without a Customer Account, in which case the Customer provides the required data with each order.
§4. Placing orders
Orders are placed by selecting the relevant options in the store. Once the order is complete, the Customer is informed of the delivery cost.
Payment can be made:
a) through PayPal;
b) through PayU – by Visa or Mastercard card, BLIK, Google Pay, Apple Pay, PayU instalments or other methods offered by PayU at checkout.
Payment is deemed made when the funds are credited by the payment operator.
The payment deadline is 7 days from placing the order, unless the chosen purchase option provides otherwise.
The order is fulfilled after payment and confirmation of the order by the store. If the payment operator reports a reversal or any irregularity, the fulfilment period is suspended until the matter is resolved.
If the order cannot be fulfilled for any reason, the Seller informs the Customer without delay. Within 7 days the Customer decides whether to order other goods, wait until the obstacle is removed, or withdraw from the contract. If the Customer does not respond, the contract is terminated. On withdrawal, all amounts paid are refunded without delay.
The standard time to prepare an order for shipment is 21–28 working days from the date payment is credited. Delivery time is in addition to this and depends on the carrier and current logistics conditions. The order is fulfilled within the time indicated when ordering or, if none is indicated, no later than 30 days from the date payment is credited and the order is confirmed by the Seller.
For goods marked "promotion", "sale" or similar, orders are fulfilled in the order in which the order and payment are received. Quantities are limited.
The contract is concluded once the Customer has provided the necessary data, accepted these Terms, clicked the "order with obligation to pay" button, made the payment, and the Seller has confirmed the contract by email to the address provided by the Customer.
§5. Delivery
Delivery is made by one of the methods offered at checkout and chosen by the Customer:
- UPS courier
- InPost courier
The Seller ships within Poland only.
The delivery cost is shown before the order is finally confirmed.
Once the parcel is dispatched, the Customer receives a shipping confirmation email with the shipment details and tracking information.
If the goods are returned to the Seller because of:
a) incorrect address details;
b) the Customer failing to collect the parcel;
c) another reason attributable to the Customer,
the Seller may charge the Customer the resulting costs, in particular the cost of re-sending the goods.
If the parcel shows any irregularities, in particular external damage, the Customer should ask the courier to draw up a damage report. Failing to do so may make it harder to establish the cause of damage, but does not affect the Consumer's statutory rights.
§6. Complaints, size exchange
The Seller must deliver goods that conform to the contract and to their description in the store.
Complaints can be submitted by email to support@fadaria.com or by post to: Fadaria Maciej Krawczyk, ul. Szlak 77, lok. 222, 31-153 Kraków, Poland.
The Seller confirms receipt of a complaint by email.
The Seller responds to a complaint within 14 days of receiving it. If the Seller does not respond within that time, the complaint is deemed accepted. The Customer is informed of the outcome by email.
The costs of delivering goods under complaint to the Seller, and of their repair or replacement, are borne by the Seller – before sending, the Customer contacts the Seller to receive shipping instructions. If the complaint is accepted, the Seller repairs the goods, sends replacement jewellery by courier, or refunds the money using the same payment method the Customer used, unless the Customer has expressly agreed to another method at no cost to them.
The Seller is liable to the Consumer for any lack of conformity of the goods with the contract that existed at delivery and becomes apparent within 2 years of delivery, under Articles 43a–43q of the Polish Consumer Rights Act. The Consumer may request repair or replacement and, in the cases provided by law, a price reduction or withdrawal from the contract. Liability towards Customers who are not Consumers is set out in §11.
Within 14 days of receiving a ring or wedding band, the Customer may send it back to the Seller to exchange it for a different size. Before sending, the Customer contacts the Seller to receive instructions. The Seller inspects the returned piece; if it shows no signs of wear, the Seller, at no extra charge, resizes it or, where the design does not allow resizing, makes a new piece in the requested size, and ships it to the Customer free of delivery costs. Resizing takes about 2 weeks; a new piece is made within the standard order processing time set out in §4. The free size exchange is available once for each piece. The cost of sending the piece to the Seller is borne by the Customer. After 14 days, resizing is chargeable. The size exchange does not apply to pieces engraved or changed to the Customer's specification (see §7).
§7. Right of withdrawal (Consumers)
This section applies to Consumers and to natural persons concluding a contract directly related to their business where the contract is not of a professional nature for them (Art. 38a of the Polish Consumer Rights Act).
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days from the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods.
To exercise the right of withdrawal, you must inform the Seller at the email or postal address given in §2 of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email).
You may use the model withdrawal form included in the Returns and Complaints Policy, but it is not obligatory. If you send your statement by email, we will send you acknowledgement of receipt on a durable medium (e.g. by email) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for supplementary costs resulting from your choice of a delivery type other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earliest.
Please send back the goods to: Fadaria Maciej Krawczyk, ul. Szlak 77, lok. 222, 31-153 Kraków, Poland, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The right of withdrawal does not apply to contracts:
for the supply of goods made to the consumer's specifications or clearly personalised, in particular:
- engraving
- sizes outside the range offered in the store
- bespoke designs
- modification of stones or the band
- other personalisation services
for services fully performed with the consumer's express consent, where the consumer was informed beforehand that they would lose the right of withdrawal once the service is fully performed;
other contracts listed in Art. 38(1) of the Polish Consumer Rights Act.
§8. Out-of-court dispute resolution (Consumers)
The Consumer may seek out-of-court resolution of a dispute, including through a consumer arbitration court, which also requires the Seller's consent.
The Consumer may seek help from a district (municipal) consumer ombudsman (Powiatowy/Miejski Rzecznik Konsumentów) or from consumer organisations (e.g. Federacja Konsumentów, https://www.federacja-konsumentow.org.pl).
More information on consumer rights is available on the website of the Office of Competition and Consumer Protection (www.uokik.gov.pl). A Consumer from another EU country may ask the European Consumer Centre in their country (ECC-Net) for help.
§9. Personal data
The controller of personal data is the Seller – Fadaria Maciej Krawczyk. Full information on how personal data is processed is available in the Privacy Policy.
§10. General provisions
The Customer must not do anything prohibited by law, in particular infringe the rights of third parties, and must use the store in a way that does not disrupt its operation, including:
a) not sending unsolicited commercial information through the store;
b) not using other Customers' accounts without authorisation;
c) not attempting to gain access to other Customers' accounts;
d) not distributing unlawful content.
Disputes arising from contracts concluded through the store are resolved by the common court competent for the Seller's registered address in Kraków. This does not apply to Consumers, for whom jurisdiction is determined by applicable law.
Contracts concluded in the store are governed by Polish law. This choice of law does not deprive a Consumer of the protection afforded by mandatory provisions of the law of the country of their habitual residence.
§11. Provisions for non-consumers
This section applies only to Customers who are not Consumers.
The Seller may limit available payment methods, including requiring full or partial prepayment.
The Customer must pay the price and collect the goods without delay, and no later than 7 days from concluding the contract, unless agreed otherwise.
Goods remain the Seller's property until the price and delivery costs are paid in full.
When the Seller hands the goods to the carrier, the benefits and burdens and the risk of accidental loss or damage pass to the Customer. The Seller is not liable for loss, shortage or damage arising from acceptance for carriage until delivery, or for delays in transit.
The Customer must inspect the parcel in the time and manner customary for such deliveries and take all steps necessary to establish the carrier's liability for any loss or damage, failing which they lose the right to rely on it in a dispute with the Seller.
The Seller's liability, regardless of its legal basis, is limited – per claim and in total – to the price paid and delivery costs under the contract, and covers only typical damage foreseeable when the contract was concluded, excluding lost profits.
Statutory warranty (rękojmia) is excluded.
Polish law applies.
§12. Changes to the Terms
The Seller may change these Terms. Changes will be clearly published in the store at least 14 days before they take effect. Customers with a Customer Account will also be notified by email.
Changes do not affect orders or payments made before they take effect.
§13. Final provisions
These Terms take effect on 10 October 2026 and apply to all customers of the fadaria.com online store.
Matters not covered by these Terms are governed by the Polish Civil Code and the Polish Consumer Rights Act.
